If you are able to consult with customers one-on-one, ask any new clients how they heard about you. This will be trickier if you own a restaurant or clothing store since you won’t be able to track down every customer to ask how they heard about you. In these instances, consider asking customers to take a survey on every receipt. Offer an incentive (coupon, discount, etc.) to increase the chances that people will actually fill it out.
There are many vendors out there who sell lists or rent them (though renting means that the list seller maintains ownership and control of the email list). Different jurisdictions have taken different approaches to privacy issues with advertising. The United States has specific restrictions on online tracking of children in the Children's Online Privacy Protection Act (COPPA),:16–17 and the FTC has recently expanded its interpretation of COPPA to include requiring ad networks to obtain parental consent before knowingly tracking kids. Most email marketers around the world are legally required to allow recipients to opt out of emails they no longer want to receive. Contacts must be able to do this directly in the email message. The General Data Protection Regulation (GDPR), a European data privacy act that went into effect in May 2018, doubles down on the opt-in side of this relationship. I’m not happy at all with MailChimp. Has anyone found the same problems with MailChimp as I have? I find that many of my list members unsubscribe from my list daily. I know these people ands contact them and they say they have not unsubscribed. twice I even found my own email taken off the list. When I look into the MailChimp list Spam is the reason for the person’s unsubscription. Over the years I’ve been on MailChimp I’ve contacted support and I’ve done everything I can but nothing has changed. I’m now looking to move to another company.

The CAN-SPAM Act of 2003 was passed by Congress as a direct response to the growing number of complaints over spam e-mails. Congress determined that the US government was showing an increased interest in the regulation of commercial electronic mail nationally, that those who send commercial e-mails should not mislead recipients over the source or content of them, and that all recipients of such emails have a right to decline them. The act authorizes a US $16,000 penalty per violation for spamming each individual recipient. However, it does not ban spam emailing outright, but imposes laws on using deceptive marketing methods through headings which are "materially false or misleading". In addition there are conditions which email marketers must meet in terms of their format, their content and labeling. As a result, many commercial email marketers within the United States utilize a service or special software to ensure compliance with the act. A variety of older systems exist that do not ensure compliance with the act. To comply with the act's regulation of commercial email, services also typically require users to authenticate their return address and include a valid physical address, provide a one-click unsubscribe feature, and prohibit importing lists of purchased addresses that may not have given valid permission.

The DMA’s 2017 Response Rate Report finds that the response rate for mail sent to people on house lists (subscribers who opted in to mail) was 5.1% for the year, and the response rate for prospect lists (potential clients) was 2.9%. These numbers are up from 2003, when house lists drew a response of 4.4% and prospect lists a response of 2.1%. The subheadings in the email blast also need to engage the reader. Many recipients will not actually read the whole thing and instead, they will scan the newsletter. When they scan through the email blast, the subheadings will be one of the parts most likely to catch their attention. Use your subheadings as a way to organize the relevant information in the content of the email to make it easy for your readers to jump to the information that is relevant to them.

Write a compelling subject line. The subject of your email will be the first thing that people will see when viewing it. Because of the immense amount of spam that exists, it's important that you draw the recipient in enough so that they open the message. The subject line should invite the reader to some benefit or include a sense of urgency which requires action. Avoid cliche marketing terminology like "act now" or "free limited offer" as these subject lines can make recipients feel suspicious and turned off. Your subject line should be 50 characters or less.
If ebooks aren't your jam, create tools instead. I don't recommend a one-or-the-other approach, necessarily, but if you have more development talent than writing talent, this may be a more attractive option for you. These tools can be valuable enough to some of your website visitors that they'll trade you their email address for a free demo of the product you built. Then, for your first email, ask them what they thought of the tool. It's the perfect icebreaker.
